In the stete of emegency, the legislative and judicial branches must give to the excutive the power to derogate human rights, but the excutive itself must also follow due process of law when applying deragation of right. This paper analyzes the theoretical basis and the aperational sequence of executive activities, along with the incompatibilities of Vietnamese law in thia context with the purpose of protecting the rights of the people.
