Although freedom of expression and access to information (FOE/l) are internationally recognised human rights, their recognition in practice remains patchy. States commonly justify restrictions on these freedoms on national emergency and security grounds. The Covid-19 pandemic is such an emergency. In such cases balancing freedom of expression and access to Information and public order is challenging for governments. This paper analyses the extent to which these freedoms can be justifiably limited in states o f emergency. The paper then examines the practice o f digital rights in Vietnam, specifically, the aim is to show how digital rights vis-a-vis the spread of fake news and disinformation have been restricted during the Covid 19 pandemic In Vietnam.
